A discussion of how to administer employee benefits when an employee goes out on leave, including leaves under FMLA, CFRA, PDL, and USERRA. Which benefits must employers offer, for how long, and how are they paid for (including a discussion of the impact on cafeteria plan elections). Designed to answer common questions employers and producers often hear—and work through familiar scenarios—this interactive program will include examples, best practices, and action items.

Marilyn A. Monahan specializes in employee benefits (with an emphasis on health and welfare plans) and insurance corporate and regulatory law.
Marilyn began her career as a litigator. She has represented parties in a variety of cases, involving product liability, professional malpractice, contract, and ERISA claims. Her experience includes handling matters before the federal and state trial and appellate courts, as well as arbitrations and mediations.
As part of her insurance and employee benefits practice, Marilyn assists her clients with their compliance obligations under federal and state employee benefit and insurance laws and regulations, including health care reform, ERISA, COBRA, HIPAA, FMLA, and the Internal Revenue Code. She represents insurance companies, HMOs, consulting firms, privately-held and publicly-traded companies, governmental entities, and collectively bargained health and welfare plans. Marilyn writes plan documents, summary plan descriptions, compliance manuals, and communications materials. Her transactional practice includes drafting and negotiating various types of contracts, including agency contracts and administrative services agreements.
